These Terms of Service ("Terms") govern the ITWorks application (the "App") — the TikTok integration of the JARVIS marketing-operations platform — operated by ITWorks Technology ("ITWorks", "we", "us", "our"). The App is an internal marketing-operations tool that ITWorks uses to publish its own short-form video content to a single TikTok account that ITWorks owns and controls. The App is not a public service and is not offered to third-party creators. By connecting a TikTok account to the App or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.
By connecting a TikTok account to the App and using it, the authorized ITWorks operator ("you") agrees to these Terms, to the ITWorks Privacy Policy, and to TikTok's applicable terms and guidelines referenced below. These Terms form a binding agreement between you and ITWorks. If you use the App on behalf of ITWorks, you represent that you are authorized to do so and to bind ITWorks to these Terms.
The App is intended solely for authorized ITWorks personnel acting on behalf of ITWorks. You must be at least 18 years old and legally able to enter into these Terms. You may connect and manage only TikTok accounts that ITWorks owns and is authorized to operate. You are responsible for ensuring your use complies with all applicable laws and with TikTok's terms and policies.
The App lets an authorized ITWorks operator (a) connect the official ITWorks TikTok account via TikTok Login Kit, (b) review ITWorks-created videos in a confirmation screen that shows the connected account name and avatar and a privacy-level selector, and (c) publish those videos to the ITWorks TikTok profile, or send them to the TikTok inbox as drafts, through the TikTok Content Posting API. The App displays basic account information and the account's own metrics inside the private JARVIS dashboard.
To operate, the App stores the OAuth credentials TikTok issues for the connected account (access token, refresh token, open ID, granted scopes, and expiry). You are responsible for safeguarding access to the JARVIS dashboard and for all activity conducted through your connected account. You must promptly disconnect the account and notify us if you believe credentials have been compromised. How we store and handle these credentials is described in the ITWorks Privacy Policy.
Content published through the App is created and owned by ITWorks (product highlights, tech tips, store updates, and similar brand content). We do not publish scraped, re-uploaded, infringing, misleading, or third-party content through the App. Each publish action is initiated and confirmed by the operator — the App does not bulk-spam or post without confirmation. You are responsible for ensuring that content published through the App is lawful, accurate, and does not infringe the rights of any third party.
Use of the App is subject to, and we comply with, TikTok's Terms of Service, Privacy Policy, Community Guidelines, the TikTok Developer Terms of Service, and TikTok's Content Sharing Guidelines. Where these Terms conflict with TikTok's terms regarding use of the TikTok API, TikTok's terms prevail. TikTok is a third-party service and is not a party to these Terms.
The App relies on TikTok's platform and APIs and may rely on other third-party infrastructure. Your use of those services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services, and we do not control changes they may make to their platforms or APIs.
The App, the JARVIS software, and ITWorks brand materials are owned by ITWorks or its licensors. TikTok trademarks and the TikTok platform are the property of TikTok. Nothing in these Terms grants rights to either party's marks beyond what is necessary to operate the integration. All rights not expressly granted are reserved.
Our collection and use of data obtained through the TikTok API is described in the ITWorks Privacy Policy, which forms part of these Terms. By using the App you acknowledge that policy.
The App is provided "as is" and "as available" for ITWorks' internal use, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty that the TikTok API or the App will be uninterrupted, secure, or error-free. TikTok may change or restrict its API at any time; the App's behavior depends on TikTok's services, which are outside our control.
To the maximum extent permitted by law, ITWorks and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of the App or the TikTok API, whether based in contract, tort, or any other legal theory. To the extent liability cannot be excluded, it is limited to the greatest extent permitted by applicable law.
You agree to indemnify and hold harmless ITWorks and its personnel from any claims, damages, liabilities, and expenses arising out of your misuse of the App, your violation of these Terms, or your violation of TikTok's terms or any applicable law.
These Terms apply for as long as the App is connected to a TikTok account or in use. You may stop using the App and disconnect the connected account at any time, which revokes the App's access and results in deletion of the stored credentials as described in the Privacy Policy. We may suspend or terminate access to the App at any time, including where required to comply with TikTok's terms or applicable law. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) survive.
We may update these Terms from time to time. The effective date above reflects the latest version, and material changes will be posted on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Lebanon, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Beirut, Lebanon.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or transfer of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and ITWorks regarding the App and supersede any prior agreements on this subject.
